Terms & Conditions

REPAVE LTD

  1. 1. Definitions

    1.1 “Company” refers to Repave LTD.
    1.2 “Customer” refers to any individual or business purchasing services from the Company.
    1.3 “Works” refers to all services provided by the Company, including but not limited to driveway installation, paving, resurfacing, groundwork, drainage, sealing, and repairs.
    1.4 “Quotation” refers to the written estimate provided by the Company.


    2. Quotations & Acceptance

    2.1 All quotations are valid for 30 days unless otherwise stated in writing.
    2.2 Acceptance of a quotation (verbal or written) constitutes full acceptance of these Terms and Conditions.
    2.3 Any additional work requested after acceptance may incur extra charges and will be agreed upon before proceeding where possible.


    3. Deposits & Payments

    3.1 A deposit may be required before commencement of Works.
    3.2 The remaining balance is due immediately upon completion unless otherwise agreed in writing.
    3.3 Late payments may incur interest at a rate of 8% above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts legislation.
    3.4 The Company reserves the right to suspend or withhold work in the event of non-payment.


    4. Customer Responsibilities

    4.1 The Customer must ensure clear, safe, and unobstructed access to the work area.
    4.2 The Customer is responsible for obtaining any necessary permissions, permits, or approvals unless agreed otherwise in writing.
    4.3 The Customer must disclose any known underground utilities, pipes, cables, or hazards prior to commencement.
    4.4 The Customer must ensure that the site is suitable for the Works unless a prior site survey determines otherwise.


    5. Materials & Workmanship

    5.1 Materials used may vary slightly in colour, texture, and finish due to natural variation and manufacturing differences.
    5.2 The Company will carry out all Works with reasonable skill and care, in accordance with accepted industry standards.


    6. Delays & Unforeseen Circumstances

    The Company shall not be liable for delays caused by:

    • Adverse weather conditions
    • Supplier or material shortages
    • Unforeseen ground conditions
    • Events beyond reasonable control

    Project timelines are estimates and not guaranteed completion dates.


    7. Waste Removal & Site Conditions

    7.1 Standard waste removal is included only where specified in the Quotation.
    7.2 Removal of hazardous materials, contaminated soil, or hidden obstructions is not included unless explicitly agreed.


    8. 5-Year Workmanship Warranty

    8.1 The Company provides a 5-year workmanship warranty covering defects directly resulting from faulty installation.
    8.2 The warranty applies only to significant failures attributable to workmanship.
    8.3 This warranty is non-transferable unless agreed in writing.


    9. Warranty Exclusions

    The warranty does not cover:

    9.1 General Exclusions

    • Natural wear and tear
    • Accidental damage
    • Misuse, neglect, or lack of maintenance

    9.2 Cracking

    • Minor or hairline cracks caused by:
      • Ground movement
      • Temperature changes
      • Settlement or shrinkage
    • Cracks caused by:
      • Subsidence
      • Tree roots
      • Drainage issues
      • Frost or heavy loads

    9.3 Weed Growth

    • Weed, moss, or algae growth between joints or surfaces
    • The Customer is responsible for ongoing maintenance

    9.4 Vehicle Use

    • Damage caused by:
      • Heavy commercial vehicles
      • Skips or machinery
      • Caravans or excessive loads beyond domestic use

    9.5 Staining

    • Oil, fuel, chemical, rust, or tyre staining

    9.6 Colour Changes

    • Natural fading or weathering over time

    9.7 Drainage & Flooding

    • Issues arising from existing site conditions or extreme weather

    9.8 Third-Party Damage

    • Damage caused by:
      • Other contractors
      • Utility companies
      • Accidents or alterations after completion

    9.9 Extreme Weather

    • Storms, flooding, frost, heatwaves, or other “Acts of Nature”

    10. Maintenance Responsibility

    10.1 The Customer is responsible for maintaining the installed surface, including:

    • Cleaning
    • Weed control
    • Resealing (where applicable)

    10.2 Failure to maintain the surface may void the warranty.


    11. Cancellation Rights

    11.1 Customers may have the right to cancel under the Consumer Contracts Regulations 2013 where applicable.
    11.2 Cancellation requests must be made in writing within the statutory period.


    12. Liability

    12.1 The Company’s liability is limited to the total value of the contract.
    12.2 The Company shall not be liable for:

    • Indirect losses
    • Consequential losses
    • Loss of income or business

    Nothing in these Terms excludes liability where prohibited by law.


    13. Complaints Procedure

    13.1 Any concerns must be reported in writing within 7 days of completion.
    13.2 The Company must be given a reasonable opportunity to inspect and rectify any valid issues.


    14. Governing Law

    These Terms and Conditions are governed by the laws of England and Wales.
